LV Loses to DB

The court has ruled in favor of Dooney & Bourke in the trademark lawsuit against them from Louis Vuitton. These type of cases are very common in the fashion world, especially with brands that use their logos as a design.

This particular lawsuit began in 2004 when LVMH (that's right, Louis Vuitton, Moet and Hennessey are under the same management) stated that Dooney & Bourke's DB Monogram infringed on LV's multicolored monogram bags (both pictured you be the judge). Yes, they are the same color, but the logos are totally different. I guess infringement can be based on idea as well. You lawyer people out there, please help me out with this.. shed some light on the matter..
If you ask me, neither of these bags aren't that significant. I don't have a real view on this since I don't wear purses, but I do have 2 sisters and I do look at purses to buy them from time to time,...and I can say that I like the classic monogram for LV, and the all leather DB bags WITHOUT THE DB LOGOS! The DB bag does come across as a lame marketing strategy to capitalize on the market's demand for logo bags, but Hey, the Law done said its OK, so do your thing Dooney!!
